The Department of Justice will be used by President-elect Joe Biden to crack down on police departments allegedly engaged in ’systemic misconduct’ in part by the use of consent decrees. The campaign website of Mr. Biden has vowed to ’expand and use the power of the U.S. Justice Department to address systemic misconduct in police departments and prosecutor’s offices.’

Wonderful. Allow me to tell you a story. When someone drives drunk, falls asleep in their car, argues with police for 45 minutes, wrestles with police, steals one of their tazers, and then discharges that weapon at police, the appropriate response is to neutralize the threat and then allow for the community burns down the Wendy's. Now what will happen is a tow truck will put a boot on his car and a paramedic will show up and administer some narcan because why not and then the drunkard will attack both of them with a knife. Am I wrong?

To those who think Biden is federalizing the local police he’s not, actuality more like he can’t. While he does have the power to deploy the military to local municipalities, it only happens when local and state governments are ignoring national laws and/or SCOTUS rulings. For example: in 1957 President Dwight Eisenhower deploying parts of the 101st airborne to Little Rock Arkansas after its governor used the state national guard top block 9 African American students from attending following the Brown v. Board of Education 347 U.S. 483 (1954) ruling. Rather he intends to direct the Department of Justice, which is a power the president has, to pressure police departments and prosecutors who have a history of misusing the powers granted to them into a consent decree. A Consent Decree is an agreement that that alters a department’s procedure without accepting any blame. It was codified into law as part of the 1994 crime bill, allowing the DOJ to target departments with histories of lawless behavior (bribery, evidence planting, etc.). The alternative to this process is a long-drawn-out lawsuit between the local police department and the federal government, and in case you haven’t noticed lawyers and attorneys are expensive to hire.
