Supreme Court rejects appeal of B&B owner who denied room to same-sex couple

The Supreme Court on Monday left in place Hawaii court rulings that found a bed and breakfast owner violated the state’s anti-discrimination law by refusing to rent a room to a lesbian couple. The court rejected an appeal from Aloha Bed & Breakfast owner Phyllis Young, who argued that she should be allowed to turn away gay couples based on her religious beliefs.

It's supposed to be a business owner's right to be able to refuse service to anyone for any reason. If the refusal of service is unpopular enough amongst the customer base, guess what? Capitalism determines if that business continues to operate or go out of business. This is just ridiculous.

You can't refuse any general service based on any protected class. You can refuse special services though. That is why the refusal of special service of the cake decoration was upheld where as reserving a standard room is in violation. This makes sense from a point of practical access and civil unity. Anyone can access any standard good or service. This prevents parallel societies that invariably lead to nasty civil wars. However, this also preserves the right of an artisan or purveyor to not be compelled to extra work beyond standard.

@dm, it's the reality that if you are open for business you can't discriminate on the basis of color, religion, sexual orientation among others. Gay bars don't discriminate against you. The law is based on reason, which you obviosly are unable to do.
