As far as I'm aware, this doesn't fall under distribution. (I'm speaking about UK law, although the US has similar laws in regards to narcotics, possession and distribution). While "possession", would be a charge, and "distribution", may be a charge if he sold the drugs; the act of planting the narcotics on another member of the public would be considered as 'police corruption'. In the event that the defendant is actually guilty, but the evidence to convict isn't available, the act of "planting evidence", is referred to as 'Noble Cause Corruption'. However, in this instance, I believe that these activities fall under the title of "entrapment".
