Crew member who survived California dive boat fire files lawsuit against owner

Ryan Sims, crewman injured while escaping the fire that killed 34 people aboard a dive boat off Southern California sued the vessel’s owner and the company that chartered it. He filed the lawsuit last week in Ventura County Superior Court saying the boat was unseaworthy and operated in an unsafe manner.

"All six crew members were asleep when the boat caught fire"... So to me it seems the crew... screwed up by not having anyone on duty at all times. So they were not the seaworthy ones.

If the crew wasn't trained properly and the boat not well-maintained, and he recognized that ahead of the incident, then why was he working on that boat?

if all that is claimed was true then why would he have gotten on in the first place? I know I damn sure wouldn't.
