Five men acquitted of rape because unconscious teenage victim didn’t fight back

A Spanish court’s decision to acquit five men accused of gang-raping a 14-year-old girl has provoked outrage. The court ruled out rape because the victim was in an ’unconscious state’ and the accused had not used violence or intimidation. Instead, the five were convicted and jailed for the lesser crime of sexual abuse which involves a sentencing of between 10 and 12 years in prison.

I’m no expert in Spanish law, but I’d assume the requirements for rape require violence and intimidation. It also seems they don’t have sex with a minor as rape. I think laws should be changed but all five men are still going to prison and with a case like being so known, these men will get what they deserve in prison.

"rape was ruled out because the accused did not use violence or intimidation" Um, yeah but consent is key here, no? Correct me if I'm wrong, but isn't lack of consent all you need to convict someone of rape? Especially if the accused was aware the victim was not or could not consent.

They were found guilty of sexual assault but not guilty of rape because of legal definitions in Spain being different... just like any other country

Why are people complaining that these guys got off the hook when they were still convicted and will be spending 10-12 in prison for sexual abuse? "Oh, does this mean I can rape people in Spain as long as I don't use force or violence?" No! it means you'll be convicted of a related charge. A decade long prison sentence isn't an endorsement of the crime you muppet.

It should be rape, not sexual abuse. 1. A woman should not be hanging out with 4 guys alone 2. She should not have been playing a drinking game 3. She should not have gotten so drunk she 'couldn't tell what she was or wasn't doing' People will not take responsibility for their actions these days.
