Iowa Man Sentenced to 16 Years for Tearing Down, Burning Rainbow Flag

A man was sentenced Wednesday to 16 years in prison after he set fire to a church LGBTQ flag in June. Adolfo Martinez, 30, of Ames, was found guilty of a hate crime — a class ’D’ felony — third-degree harassment and reckless use of fire. Police said he stole a pride banner hanging at Ames United Church of Christ and burned it early June 11 outside Dangerous Curves Gentleman’s Club.

The only thing he did wrong was steal a flag, and destroy it. Misdemeanor. Hate crime designations are anti-free speech, and are cruel and unusual punishments and thus a violation of the Eight Amendment. Hate crimes are ridiculous, the intent doesn't matter the crime does. Is a muslim shoplifting from a jewish store committing a hate crime because he was told by his local imam "jews are the worst enemies of islam?" No, he isn't, he is shoplifting.

The right can throw a mother in jail for a miscarriage for 20 years, and think it's ok or deny even doing it. Oops over 400 cases of that. I see theft here and a man exercising his first amendment. Just because you don't agree with someone's opinions doesn't mean they belong in jail. He is entitled to disagree with that flag and what it represents. He has a right to speak out about it and Burma flag if he chooses to without threat of government action. "Hate crime" laws are being abused here. If someone else is not physically attacked then hate crime laws should not be applied.

His deed reminds me of why thugs could abduct torture n murder Matthew Sheppard.... The brazen to steal it off a church n then burn it... If he wanted he could have simply obtained one legally the burned it in full lawful protest thus expressing his first amendment freedom.. People are allowed to burn American flags but not Rainbow Flags? The only thing this guy did wrong in this situation was that he stole and destroyed other people's property which yes does warrant some kind if punishment. The amount of punishment he is getting seems excessive but the article did say something about him having past offenses.
