New evidence points to innocence of death row inmate in 1985 killing

Lawyers for a man facing execution in Florida filed an appeal claiming a co-defendant in the case is ready to testify he acted alone. The appeal on behalf of James Dailey, an accused in the 1985 slaying of a 14-year-old girl, came three days before a stay of execution expires. The filing included a statement from Jack Pearcy saying he is solely responsible for the death of Shelly Boggio.

He appears to have been involved in the disposal of the 14 year old girl's body, at a minimum but may not have "murdered" her. Articles didn't say whether he was guilty of her rape or not, but if not then why didn't he stop it?
