Missouri cop accused of manslaughter after killing girl in on-duty accident

A Missouri police oficer who fatally struck a four-year-old with a cruiser while driving onto a sidewalk was charged with first-degree involuntary manslaughter. Andria Heese, 28, of the Columbia Police Department, hit Gabriella Curry on January 4 while trying to park her police cruiser on a sidewalk at the entrance of Battle High School. Heese faces three to 10 years in prison if convicted.

Whole thing is just sad. On a side note, $3.4 million for wrongful death seems excessive. Wonder why the court/jury decided to give away so much money. Where is an actuary when you need one?

This charge is good, it's how a member of the public would also be treated. That said, this was clearly an accident, not incompetence, and not malfeasance. The defense is likely to argue that the mother should have been watching over the 4 year old in an area with lots of vehicles for precisely the reason that happened - it was dangerous to let a small child wander in and out of a high traffic area without an adult. The prosecutor is likely to argue that the officer should have been paying better attention. Either way I am satisfied just with the officer being charged; it's fair.

I would bet that the officer did not start her day thinking I sure hope I get the chance to run over a nd kill a four year old. I have no doubt she feels terrible about it. But driving on a sidewalk in front of a school with busses present. she needs to be punished with more than probation. Maybe not 10 years but something.
