Appeals court orders judge in Flynn case to respond to demand to dismiss charges

A federal appeals court on Thursday ordered the judge handling the criminal case of Michael Flynn to respond, by June 1, to a request by Flynn’s lawyers to dismiss the case. Flynn’s attorney earlier this week had filed an emergency writ of mandamus seeking that the prosecution against Flynn be dismissed as the Justice Department has requested, and for Judge Emmet Sullivan to be taken off the case.
