Florida’s ban on bans will test First Amendment rights of social media companies

On Monday, Governor Ron DeSantis signed into law the Stop Social Media Censorship Act, which greatly limits large social media platforms’ ability to moderate or restrict user content. The bill is a legislative distillation of Republican anger over recent episodes of supposed anti-conservative bias, like Twitter and Facebook shutting down Donald Trump’s account.

I quit posting to fb and the rest about a year ago. Ofcourse alot of my decision was seeing how social media could silence the leader of a country, but another part was it just became to invasive and distracting for me. Folks waste so much time and attention to the timeline, that they sacrifice actual real experiences for a selfie or a tweet. I believe if a study were conducted, there would be evidence that social media leads to some type of delusional, or alter ego, vanity, mental illness. And if already mentally ill, or suffering from a psychological disorder, social media strengthens the delusion. Just my two cents. I believe it hurts more than it helps. We were all alot happier when the phone was on the wall, and we went about our day oblivious to minute by minute updates of things that MOSTLY have no direct bearing on how your day is going.

Please, social media companies don't get first amendment protections, they are corporations not people. They have 230, but that if for platforms not publishers. Their urge to editorialize is opening them up to have that status revoked potentially.

I am down with this since it became a dumpster fire. I remember the days of MySpace and when 4 chan was a little cleaner. Fb was an alternative to MySpace which was fine for the first few years then pretty much had the same problems of MySpace. Too much drama like always and no privacy.

"Republican anger" that entire summary seemed pretty biased. Social media not only censor conservatives but they also a variety of other topics including ones related to China and Taiwan.

We do need regulations in social media. Whenever a social media is created with the soul purpose of “free speech”, like 8chan or parlour, it’s just gets over run with CP and literal terrorists (not maga or BLM but actual terrorist groups).

It’s simple: either social media platforms’ rules/bans are considered their opinions and thus they are a publishers which should open them to lawsuits on everything that’s posted on their platforms. Or they are a free platform allowing everybody to post and thus are protected by section 230. Somehow it’s currently both a publisher and protected by section 230.

They're going to have to pick one or the other--either be "common carriers" with liability protection but the duty to be open to all, or media organizations with First Amendment rights but exposure to libel, slander and anti-trust regulations. They've had it both ways for too long.
