Michigan school teacher: I was fired after tweeting ’Trump is our president’

A teacher at Walled Lake Western High School said he was fired from his job after tweeting ’Trump is our president.’ The school district has denied his support for Trump was the reason for his termination, but refused to give specific reason for his resignation. Justin Kucera, 28, said he was fired after being summoned to a Zoom meeting where he was questioned about three tweets he sent July 6.

I would like to believe that the union is leading the litigation and efforts to restore the employment of a union member. If these are the only facts, the school district doesn't have a legal "leg to stand on " in court. This matter should be litigated in federal courts as a Title VII and Section 1983 claim. Employment discrimination and violation of Constitutional due process rights. Tactical reason for both. Different presumptions and burdens. Right to attorney fees and costs. Punitive damages are unlikely.
