$9.75M settlement to be paid by Apple over alleged Powerbeats 2 design defect
People who have purchased a pair of Powerbeats 2 earbuds are eligible to submit a claim. This claim would enable people to receive a payment of as much as $189. A lawsuit against Apple challenged the claim that the Powerbeats 2 were the best headphones to work out in and were built to endure. However, the earbuds require a charge after minimal use and are not resistant to a lot of sweat and water.

A settlement of this litigation doesn't mean Apple or any company who settles litigation actually did something wrong. It's just means it is more economical to write a check today than pay the costs for defending your rights in litigation through trial or appeal. Business owners can be diligent and responsible and decrease risk and actual liability but, there is no way to avoid the costs of litigation. The only things that can't be avoided are death, taxes and litigation.
